General Terms and Conditions and Customer Information
I. General Terms and Conditions
§ 1 Basic provisions
(1) The following terms and conditions apply to contracts that you conclude with us as provider (Danny Paul Rüdiger Riewoldt-Liehr) via the website https://angelrollentuning.de/. Unless otherwise agreed, the inclusion of any terms and conditions of your own that you may use is hereby rejected.
(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of its independent professional or commercial activity.
§ 2 Conclusion of the contract
(1) The subject matter of the contract is the sale of goods and/ or the provision of repair services and/ or the provision of installation services.
(2) As soon as the respective product is placed on our website, we submit to you a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the item description.
(3) The contract is concluded via the online shopping cart system as follows:
The goods and/ or repair services intended for purchase are placed in the "shopping cart". You can call up the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time.
After clicking the button "Checkout" or "Continue to order" (or similar wording) and entering your personal data as well as the payment and shipping conditions, the order data are finally displayed to you as an order overview.
If you use an instant payment system (e.g. PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay) as your payment method, you will either be taken to the order overview page in our online shop or redirected to the website of the provider of the instant payment system.
If you are redirected to the respective instant payment system, make the appropriate selection or entry of your data there. Finally, the order data are displayed to you as an order overview on the website of the provider of the instant payment system or after you have been redirected back to our online shop.
Before submitting the order, you have the opportunity to check the details in the order overview again, to change them (also via the "back" function of the internet browser) or to cancel the order.
(4) Your requests for the preparation of an offer are non-binding for you. In response, we will submit to you a binding offer in text form (e.g. by email), which you can accept within 5 days (unless a different period is stated in the respective offer).
(5) The processing of the order and the transmission of all information required in connection with the conclusion of the contract take place by email, partly automatically. You must therefore ensure that the email address you have provided to us is correct, that receipt of the emails is technically ensured and, in particular, that it is not prevented by SPAM filters.
§ 3 Individually designed goods
(1) You provide us with the suitable information, texts or files required for the individual design of the goods via the online ordering system or by email at the latest without undue delay after conclusion of the contract. Any specifications we make regarding file formats must be observed.
(2) You undertake not to transmit any data whose content infringes the rights of third parties (in particular copyrights, name rights, trademark rights) or violates existing laws. You expressly indemnify us against all claims asserted by third parties in this connection. This also applies to the costs of the legal representation required in this connection.
(3) We do not check the transmitted data for correctness of content and in this respect accept no liability for errors.
§ 5 Performance of repairs
(1) Insofar as repair services are the subject matter of the contract, we owe the repair work resulting from the service description. We perform this to the best of our knowledge and belief, personally or through third parties.
(2) You are obliged to cooperate; in particular, you must describe the defect in the device as comprehensively as possible and make the defective device available.
(3) You bear the costs of sending the defective device to us.
(4) Unless otherwise stated in the respective offer, the repair, including handing over the device for shipping, takes place within 5 - 7 days of receipt of the device to be repaired (in the case of agreed prepayment, however, only after the time of your payment instruction).
(5) If you exercise your right of termination pursuant to § 648 S. 1 BGB, we may demand 10% of the agreed remuneration as a lump-sum remuneration if performance has not yet begun. However, where the statutory right of withdrawal exists, this only applies if you exercise your right of termination only after the withdrawal period has expired. You remain entitled to prove that we have in fact incurred no costs or substantially lower costs.
Return shipping of fishing reels sent in to us is at the customer's risk. We ship the reels with a reliable shipping service provider. We are not liable for loss or damage in transit unless we are at fault (e.g. gross negligence in packaging or incorrect addressing). Higher insurance can be taken out on request.
§ 6 Special agreements on the payment methods offered
(2) Payment via Klarna
In cooperation with the payment service provider Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Schweden; "Klarna"), we offer the following payment options. Payment is made to Klarna in each case:
Use of the payment methods invoice and/ or instalment purchase and/ or direct debit requires a positive credit check. In this respect, we forward your data to Klarna for the purpose of address and credit checks in the course of initiating the purchase and processing the purchase contract. Please understand that we can only offer you those payment methods that are permissible on the basis of the results of the credit check.
You can find more information about Klarna and the Klarna terms of use for Germany at https://cdn.klarna.com/1.0/shared/content/legal/terms/0/de_de/user and https://www.klarna.com/de/.
§ 7 Right of retention, retention of title
(1) You may only exercise a right of retention insofar as the claims arise from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
§ 8 Warranty
(1) The statutory rights regarding liability for defects apply.
(2) As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to notify us and the carrier of any complaints as quickly as possible. If you do not do so, this has no effect on your statutory warranty claims.
(3) Insofar as a characteristic of the goods deviates from the objective requirements, the deviation is only deemed to have been agreed if you were informed of it by us before submitting your contractual declaration and the deviation was expressly and separately agreed between the contracting parties.
§ 9 Choice of law
(1) German law applies. For consumers, this choice of law only applies insofar as it does not withdraw the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence (principle of the most favourable treatment).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.
